Thank you for purchasing artwork from Utopia Studio Gallery in Whanganui. We want you to be completely satisfied with your purchase. Please take a moment to review our returns and refunds policy.
1. Consumer Guarantees Act 1993 (CGA)
In accordance with New Zealand's Consumer Guarantees Act 1993, our customers are entitled to certain guarantees when purchasing goods from us, including:
• Acceptable Quality: Please note that all artworks created by our artists are handmade, and as such, they may include natural marks, variations, or imperfections that are part of the artistic process. These can include:
• Slight color variations
• Textural differences
• Unique brushstrokes or tool marks
• Minor imperfections or flaws in the material (such as small paint runs or uneven surfaces). These characteristics are not considered defects. Rather, they contribute to the authenticity and individuality of the artwork. Handmade art is never "perfect" in a mass-produced sense; it is intentionally crafted with personal touches and variations that make each piece one-of-a-kind.
Because of this, such marks and variations are not grounds for returns under our policy. Please carefully consider these aspects before purchasing, as they are inherent to the nature of handmade art.
• Fit for Purpose: The artwork must be fit for the purpose that it was intended for.
• As Described: The artwork must match the description, appearance, and features as advertised or agreed upon.
If your artwork does not meet any of the above guarantees, you are entitled to a remedy under the Consumer Guarantees Act, which may include a repair, replacement, or full or partial refund.
2. Change of Mind
Please note that change of mind returns are not accepted under the Consumer Guarantees Act 1993. However, we understand that purchasing art is a personal decision, and we want to provide flexibility. Therefore, we offer a change-of-mind return policy under the following conditions:
• Returns for change of mind are considered within 7 days of purchase and at the discretion of the gallery. If the artist has been paid for the item/s, refunds or exchanges may not be applicable.
• The artwork must be in original, undamaged condition, and in its original packaging (if applicable).
• The receipt or proof of purchase is required.
• Shipping costs for the return will be at the buyer’s expense.
If these conditions are not met, the gallery reserves the right to refuse the return.
3. Damaged or Faulty Artwork
If your artwork arrives damaged or is faulty upon delivery, please notify us immediately:
• Contact us within 7 days of receiving the artwork.
